Terms of Service
These terms are an agreement between you and Cyclotron Technologies Pvt Ltd for use of FolioPact at foliopact.com. FolioPact is a Cyclotron Technologies Pvt Ltd product. Cyclotron Technologies Pvt Ltd is the operator of the service and the data fiduciary for personal data processed through it. By creating an account or using the service, you agree to these terms. If you use FolioPact for an organisation, you confirm that you can bind that organisation.
A record-keeping tool
FolioPact is a tool for keeping records of private loans: borrowers, agreements, advances, receipts, balances, schedules and exports. It is not a lender. Cyclotron Technologies Pvt Ltd does not, by offering FolioPact, lend money, take deposits, act as a non-banking financial company (NBFC), arrange credit, or provide financial, tax, accounting or legal advice.
Figures, schedules, statements and exports are calculations from the information you enter and from the rules the software applies. They are not a demand, a payoff quote, a credit decision, or a statement that an agreement, rate or recovery step is lawful. You are responsible for your own agreements, licences, tax and regulatory duties. Check important results with a qualified adviser before you rely on them.
Accounts
You need an email address you control and a password to use a private workspace. You may enable two-factor authentication for additional protection. Keep those credentials to yourself. You are responsible for activity under your account. Tell us at support@foliopact.com if you believe the account is being misused. We may refuse, suspend or close an account that breaks these terms, puts the service or other people’s data at risk, or that we are required to close.
You may stop using FolioPact at any time and you may ask us to close the account. Signing out ends the session on that browser. Closing an account does not undo files you have already exported or shared. Where the product has no self-serve deletion control, we will handle a written closure request sent to support@foliopact.com.
Your records and other people’s information
You are responsible for:
- the accuracy of the names, amounts, dates, rates and notes you enter;
- having the right, including any consent or other basis required by law, to store and use borrowers’ and other people’s details in FolioPact;
- giving those people any notice the law requires; and
- not entering real personal data into the public demo.
The bank-account field is for a masked identifier (four asterisks and at most four final characters). Do not enter a full account number, and do not upload identity documents unless a later version of the product expressly provides a private store for them and you are allowed to use it. You keep ownership of the records you submit. You give us a limited permission to host, process and display them so we can run the service for you.
Acceptable use
You agree not to:
- use FolioPact to break the law, including unlawful lending or unlawful processing of personal data;
- try to access another customer’s workspace, bypass authenticator checks, or probe the service except through a test we have agreed in writing;
- interfere with the service, introduce malware, or overload it;
- present FolioPact, its calculations or its name as if we were your lender, your NBFC, or your legal or financial adviser; or
- use the demo, exports or screenshots of fictional data as if they were a real borrower’s records.
The demo and unfinished features
The public demo uses fictional data in your browser and resets when you refresh. It is not your books. Live posting is limited to explicitly enabled pilot workspaces; private file upload remains subject to separate release controls. A control that is locked, labelled as a demo, or described as unavailable is not a promise that the feature is ready for real money or real people.
Our software
The FolioPact name, mark and software belong to Cyclotron Technologies Pvt Ltd or its licensors. These terms do not give you ownership of the software. You may not copy or resell the service except as these terms and the law allow.
Availability and changes
We may change, suspend or withdraw features, including while posting, documents and recovery are still being built. We may update these terms by posting a new version on this page and changing the “Last updated” date. If you keep using FolioPact after that date, the new terms apply. If you do not agree, stop using the service and ask us to close your account.
Disclaimers
FolioPact is provided as available. To the extent Indian law allows, we disclaim warranties of merchantability, fitness for a particular loan or business, uninterrupted access, and error-free calculations, imports or exports. We do not warrant that a balance, schedule or file will match your agreement, your bank or your accountant’s books. You check that before you act on it.
Limitation of liability
To the extent Indian law allows, Cyclotron Technologies Pvt Ltd is not liable for indirect or consequential loss, lost profit, lost data on your own device, or decisions that you or anyone else takes from records, calculations or exports. Our total liability arising out of the service in any twelve-month period is limited to the fees you paid us for FolioPact in that period. If you have not paid a fee, you use the service at your own risk, subject only to liability that the law does not allow us to limit. Nothing in these terms excludes liability for fraud, or any other liability that Indian law does not allow us to exclude or limit.
Governing law
These terms are governed by the laws of India. Courts with jurisdiction under applicable Indian law may hear disputes, except where a law gives you a right to bring a claim somewhere else that cannot be waived. The Digital Personal Data Protection Act, 2023 is described, in general terms, in the Privacy Policy.
